The easiest way to conceptualize real estate rights is to visualize a
bundle of sticks. Each stick may be separated, and given, bartered,
bought and sold. Real estate may be subdivided into many different
interest - surface rights, minerals, leases, joint ownership, limit
uses, easements, and an almost unlimited list of various contractual
rights and options that attach to a single tract of land.
In bankruptcy courts, real estate interests comprise the single
largest asset category administered through Chapter 7 & 13 files. The
great majority of all real estate legal issues arising in the course of
a case administration are resolved under state real estate laws.
