Bankruptcy Vs. Government Debt Relief
Incorporated in the new amendments to 11 U.S.C. 109(h) (the
Bankruptcy Code), all debtors are now required to participate, as
condition of filing bankruptcy under Chapter 7 or 13, in new government debt relief
option counseling and a thorough budget analysis program approved by
terms provided in the Code. Federal government debt relief counseling
must be completed during the 180 days before filing a petition. This requirement
is new as of 2005. Prior editions of the Code placed no such restriction
on individuals who filed before October 17, 2005.
