Bankruptcy Adversary Proceeding Defendants
The common meaning of Bankruptcy Defendants in Adversary Proceedings refers to the respondent in litigation
before bankruptcy courts. More properly, a party defending a cause of action in
federal courts should be referred to as the Respondent.
The actual name, whether defendant or respondent, is not the primary
focus however, because an adversary proceeding is a subsidiary lawsuit
filed in connection with bankruptcy administrations. As a separate stand
alone lawsuit, the adversary proceeding is conducted with all
formalities and protections as other federal litigation, for the purpose
of resolving disputes issues of law and fact. Once resolved, the
administration of the bankruptcy estate may resume.
