Free Legal Advice Prohibitions
The justice system is founded upon a simple yet pristine principal.
All parties appearing before a bankruptcy court must be subject to the
same laws, and receive fair and impartial consideration. To accomplish
this goal, bankruptcy judges and court personnel cannot render what may
be perceived as legal advice. This prohibition is statutorily mandated
and rigorously enforced, so that even the appearance of an impropriety
results in possible dismissal of employees, clerks, and assistants.
Debtors who expect help and free legal advice throughout the process of
filing bankruptcy generally fare badly.
