Washington State bankruptcy exemption laws are fairly generous
compared to many other jurisdictions, and further, debtors in Washington
bankruptcy cases may also elect the federal exemption compilation of
values, categories and specific items set forth in the Code. Either
state or federal laws must be selected, without mixing or matching only
the most favorable provisions. The Washington State bankruptcy court
reviews all claimed exempt property for compliance with categorical
restrictions.
Recently, Washington State bankruptcy laws where amended by
preemption to now limit access to Chapter 7 exemptions based on income.
Only debtors who earn less than the median income in the State of
Washington may file Chapter 7. After filing bankruptcy, Washington State
Courts verify tax returns and current earnings to assure legal
compliance with this new amendment.
