Higher Nevada Bankruptcy Exemptions Values
State residents are not permitted to elect federal exempt property
provision of the Code. Yet even better, the State of Nevada bankruptcy
exemptions provided by the Property Code establishes an even more
complete list, with significantly higher exemption amounts for included
items. The Nevada bankrptcy exemption law is one of the most generous of
all statutory schemes across the country, and so far, has escaped
preemption by federal value caps. Most lawyers and law firms in the
greater Las Vegas area and throughout the state charge similar attorneys
fees because of the bright line test (federal guideline) that limits consumer
attorney fees in both Chapter 7 and Chapter 13 cases throughout the
Federal Nevada District.
The Nevada bankruptcy court provides instructions for filing Chapter
7 forms, yet the requirements for legal compliance with Nevada
bankruptcy law are not included, nor are explanations of the best
options and alternatives. The official Nevada bankruptcy court
instructions are intended as only a technical guide to avoid dismissal,
and are not intended to provided debtors with free legal advice.
