Bankruptcy law in California is similar to other states, in that according to most bankruptcy lawyers, California exemptions
are woefully inadequate to maintain a poverty existence. although the
homestead value allowance is far better than other states, most personal
item categories are limited by sever value amounts. However, as most
California bankruptcy attorneys would attest, the practical limit of
seizing personal property is not provided by statute, but rather, the
practical limitation of selling used personal goods at auction of
sufficient proceeds for the cost of administration. Trustees routinely
abandon nonexempt assets that may not be profitably seized.
