Trustee Elections In Chapter 7 Cases

The interim trustee is rarely replaced in Chapter 7 consumer cases. But be aware, if creditors representing more than 20% of total debts vote to replace the temporary trustee, a creditor may become the acting trustee. In this circumstance, the creditor assumes broad authority to control case administration, collect assets, and object to discharge. An election of an alternate trustee in Chapter 7 cases would occur during a vote demanded during the 341 meeting of the creditors.
