If a trustee resigns, or is removed by the court for cause, a successor trustee may be elected by the creditors. Alternatively, if creditors do not choose to elect a trustee, the Court may appoint a successor trustee. Most often, the Court maintains a list of approved candidates who are willing to accept election or appointment. The list is comprised largely of attorneys who have previous experience serving in a similar capacity. The duties of a successor are substantially the same as provided through the Code for other trustees.
