The clerk of each court must maintain records of all Chapter 7 cases filed. These records form the official record used by the court, trustees, and all interested parties. To prevent access to the official record would be to enable trial by ambush, allowing only those persons with complete access a decided advantage to surprise, misrepresent, or hide information. The basis of all justice systems is founded upon the principal that all parties must be afforded a level playing field. Toward this goal, all people, whether formally appearing in court, or merely a curious bystander, have equal access to free bankruptcy records.
