The sources from which Chapter 7 legal definitions are derived
include many varied authorities, both federal and state, and in some
circumstances, local enactment. Be aware, legal definitions are
subject to change in response to actions taken by legislatures,
courts, and judges. The most predominant sources of legal definitions
are:
- The Bankruptcy Code, as codified in Title 11, Section 101, et
seq.
- The Federal Rules of Evidence, to the extent necessary for
admissibility of proof in bankruptcy proceedings.
- Federal Rules of Civil Procedures, which supplement bankruptcy
rules of procedure in the event a ruling section is not provided.
- Local rules of court that may be established nationally, by
federal district, division, or individual judges that apply only
within the jurisdiction granted by statute.
- Judicial opions rendered by bankruptcy courts.
- Opions published by other federal courts of record.
- Appellate decisions from state courts, to the extent applicable
state statutes are clarified (i.e. property ownership, liability,
collection laws, enforceability of judgments, etc.).
