State Of Washington Homestead Exemption Laws
The State of Washington Homestead Exemption Act divides included
property into two categories: $40,000 for real estate interests, or
$15,000 of personal property claimed as a primary residence. Also note,
that a mobile home and manufactured housing, if permanently affixed to
land, becomes part of the land and is indivisible for purposes of
partitioning values. If filing bankruptcy, the state legislature choose
to be an opt-in state under the Bankruptcy Code, that is, the state
permits residents to choose alternatively between either the state
exemption list or the federal exemption that provides for a homestead
exemption of up to $18,500, without a deduction penalty for mobile
homes.
Washington homestead exemption law also provides a rather unique
exception to value limitation. For purposes of recovering state income
tax assessments, the homestead exemption value is waived if the state
attaches retirement funds.
