Who May Claim The Oregon Homestead Exemption?

Following the effective date of the Oregon Homestead Exemption Act, as contained in the Revised Civil Statutes, when two or more persons reside in the same home, the amount of the combined total is $33,000, otherwise an individual may claim $25,000 as an exempt primary residence. Full time occupancy is not required. Although a formal declaration of specific property is also not required, state residents may optionally file the Oregon homestead exemption form to clarify which tract is claimed as a primary residence. Same sex couples, family members, spouses, and estates may all claim property as exempt according to the Oregon homestead exemption law.
