When comparing the Nevada Homestead Exemption Act and the $200,000
value limit to other state laws, Nevada residents should be quite pleased with
the legislature assessment of reasonable need. Many states limit
homestead value to $2,500 to $12,500 for the same provision. In this
regard, the Nevada homestead exemption law is unique, and despite
creditor claims to the contrary, does not cause debtors to flock into
the state as a debtor haven. In reality, the state filing rate remains
average and unremarkable.
To claim this exemption, and include all attached home improvements,
the Clerk's Office, Real Estate Division, provides free Nevada homestead exemption forms
which may designate the primary residence and prevent disputes for
owners of several different lots or parcels of land.
