Montana Homestead Exemption & Home Improvements
When filing bankruptcy and claiming an exemption under the Montana homestead exemption law,
many homeowners fear loosing home improvements and related equipment.
Landscaping, heating and air conditioning, out buildings, appliances,
and many other ordinary household items represent a substantial
investment, yet could be at risk unless precisely following the
requirements established by the Montana Homestead Exemption Act.
To become part of real estate, improvements must be permanently
attached. For example, an outside bench, if bolted to a patio deck is
attached and becomes part of an exempt home, whereas a portable bench
would be properly classified as lawn furniture. The maximum value
allowed for the state homestead exemption in Montana is $100,000, while
all other personal property exemptions are far less.
