Once taxes are declared due, nonpayment may result in liens, levies
and seizure. Many people assume the Missouri homestead exemption laws
provide protection, when in fact, tax debts are specifically excluded
and may be enforced against family homes. The Missouri Homestead Exemption Act
authorizes $15,000 as the exemption value, and as a first defense
against levies, Chapter 13 allows all past due taxes to be included in
plan of repayment and, by federal law, presumes such taxes to be paid
current. As a direct result of confirmation of the plan, tax authorities
are prohibited to execute tax judgments.
