Idaho Homestead Exemption, Taxes & Tax Liens
The basic coverage of the Idaho homestead exemption law is restricted
to a statutory maximum value of $50,000, subject to excepted liens. Of
the excepted liens, taxes and tax liens create the greatest confusion
for homeowners. Tax liens are also treated differently in Chapter 7 and
Chapter 13, depending the type of bankruptcy filed. According to the Idaho Homestead Exemption Act,
debtors in Chapter 7 may claim homes as exempt property, yet remain
subject to seizure for non-payment of taxes. In Chapter 13, back taxes
may be listed in the plan, and enforcement of collection, seizure,
foreclosure and judgment are prevented so long as the plan payments
remain current.
