A Chapter 13 trustee is neither friend or foe, but an official
appointed by the court to police legal compliance. Trustees routinely
offer help and assistance to debtors. In the event of discovering
intentional misconduct, trustees are required by law to report
violations an oppose confirmation. They file objections, offer negative
recommendations, and may instigate lengthy and expensive adversary
proceedings. And far more likely, for debtors who are entitled to
relief, Chapter 13 trustees fight for confirmation with their positive
recommendations and protected debtors from abusive creditors. In
practice, judges tend to highly value the recommendation of a trustee
above arguments from debtors or creditors.
