The Automatic Stay & Collection Actions Prevented

Help Finding Lawyers and Attorney Fee Guidelines

The bankruptcy automatic stay is similar to a statutory injunction invoked upon filing a petition. The stay is intended to immediately stop creditors from further collection of debts, including lawsuits progress, foreclosures, garnishments, correspondence, phone calls, and many other forms of debt collection. Creditors may request permission to resume collection actions of certain debts by filing a "motion to lift stay" in limited circumstances. Secured creditors are usually successful obtaining permission to reposes collateral if payments remain in arrears in Chapter 7 cases.
