The rate at which employees and small business owners are filing
bankruptcy remains at historical highs. The new Code and related
amendments are expected to stem the rate if filing bankruptcy under
Chapter 7, yet do nothing to alleviate the underlying cause which is
forcing average families, employees, and underemployed professionals in
insolvency. In the most basic sense, the new Code adopted an apathetic
stance toward American family values and needs, and instead, offers a
bleak warning - just say no to poverty. Effective? Hardly, history has
proven the fallacy of dictating morals in the face of overwhelming odds.
