Although the state does not expressly authorize a wild card exemption
to exempt cash and other traditionally nonexempt property, the homestead
provision of the New Hampshire bankruptcy exemptions does provide a
modest amount of head room. With a $30,000 limit, federal preemption
under the new value caps is not and issue. All attached personal
property becomes part of land, so long as permanently affixed, and all
improvements, appurtenances, and fixtures attached to buildings are also
included. Should you have additional questions, ask local New Hampshire
bankruptcy lawyers or law firms about state real estate law.
When filing Chapter 7, most New Hampshire bankruptcy attorneys
provide notice to all listed creditors. One of the most common mistakes
made by creditors is their failure to list all creditors. Omitted
creditors, even though omission results from negligent or innocent
errors, prevents discharge of underlying debts owed to the omitted
creditors.
