To be effective, the Delaware bankruptcy court must receive a
file-stamped form designating exempt property. However, the plain
reading of a document is not enough, and debtors who claim Delaware
bankruptcy exemptions must use a debtor's claim form, Schedule H, to
list individual property items and include the statutory authority to
retain each item listed. When retaining a bankruptcy attorney, Delaware
exemption compliance is provided. The failure to property include each
item of real and personal property claimed as exempt potentially results
in the loss of the assets in Chapter 7 cases.
