A failure to properly designate real and personal property under the
Arkansas bankruptcy exemption law may result in loss of the exemption.
Most Arkansas bankruptcy lawyers and law firms pay particular attention
to listing property in the debtor's claim form, and include the
appropriate state statute exempting the property down to the last
sub-section cite. Through experience, attorneys learn that an abundance
of caution when designating exemptions is far better than defending
against creative objections asserted by creditors.
