Utah Homestead Exemption Act creates a four tired approach for
permissible value included within the coverage of the exemption:
- $5,000 for an individual, any legally valid real estate interest
(i.e. leases, condo, time share).
- $10,000 for individual claiming a primary residence (including
mobile home and manufactured housing).
- $10,000 for a married couple, any legally recognized real estate
interest.
- $20,000 for a couple claiming a primary residence.
Utah homestead exemption law provides four exceptions: mortgage
liens, statutory liens, tax assessments, and consensual contractual
liens (i.e. home equity loans). Filing a Utah homestead exemption form
is not mandatory, and proof of ownership is routinely adequate to claim
the exemption, however, because of the potential conflicts created by
ownership of multiple homes and/or real estate interests, formal
declaration through filed noticed, prepared by an attorney, is highly
recommended to avoid potential creditor objections if filing bankruptcy.
