The South Carolina Homestead Exemption Act established a maximum
amount of $5,000 in value for an exempt primary residence. Further,
pursuant to the mandate of the state legislature, South Carolina homestead exemption laws
prevent state residents from claiming the $18,500 exemption under the
federal provision for homestead value provided by the Code.
Although not
required, the South Carolina homestead exemption form may be filed for
record within county deed records to designate specific tracts claimed.
Additional property that falls under prevue of the state statute
includes, buildings, fences, attached improvements, wells, and other
equipment that is permanently affixed to land.
